Appeals court says transgender troop ban unconstitutional; Hegseth vows Supreme Court fight

A federal appeals court on Monday ruled that a Trump administration policy implemented by Defense Secretary Pete Hegseth last year unconstitutionally expelled troops who were actively serving, the court said.

The divided panel blocked the policy in part, the court said, finding that the denials or discharges of service members violated constitutional protections, according to the ruling.

Hegseth responded to the decision by saying he would appeal to the U.S. Supreme Court, telling reporters, “see you at SCOTUS,” according to a statement from his office.

The policy, issued last year by the Defense Department under the administration, restricted transgender service in the military. The appeals court action leaves the matter poised for further review by higher courts, the ruling indicated.
