Five states approve measures barring noncitizens from voting

Voters in Kansas, Alaska, Arkansas, South Dakota and West Virginia approved ballot measures barring noncitizens from voting, with each measure receiving more than 60% support, Fox News Digital reported on Nov. 5, 2026.

Fox News Digital said the measures clarify or explicitly codify citizenship requirements for state and local elections. The report noted federal law already prohibits noncitizens from voting in federal elections.

The outlet reported the results came as Kansas saw Democrats score a major Senate upset and the Alaska Senate race remained uncalled on Nov. 5, 2026.

Fox News Digital cited a 2024 Gallup poll showing 83% of Americans, including 66% of Democrats, support requiring proof of citizenship for first-time voter registration.

The article said related measures failed in California and Arizona. It reported California’s Proposition 39 was defeated 58.5% to 41.4% and described Arizona’s measure as broader and omnibus, which the report suggested may have contributed to its defeat.

Fox News Digital quoted Jason Snead, executive director of Honest Elections Project: “I would absolutely agree that noncitizen voting bans are overwhelmingly popular” and that such measures “enjoy bipartisan support.” The report also quoted Hans von Spakovsky, a senior legal fellow of Advancing American Freedom, saying the Democratic Party is “divorced” from its voters.

The story noted the conservative-majority Supreme Court was preparing to consider Republican National Committee v. Mi Familia Vota, a case the report said could affect whether states may require documentary proof of citizenship to register voters for federal elections and remove suspected noncitizens from rolls.

Fox News Digital reported comments from Snead and Spakovsky about enforcement and verification, including references to the SAVE database at the Department of Homeland Security and concerns raised about automatic registration systems. The article cited an example it attributed to Snead that an automatic registration system in New Jersey added 6,600 noncitizens to the rolls, with nearly 400 of them voting, as part of his argument that a simple attestation has been insufficient.

The report also recounted that the SAVE America Act, which would have required proof of citizenship for federal registration, failed in Congress and became a point of contention in budget discussions, according to Fox News Digital.
