Prosecutors seek dismissal of vandalism case against David Hearn

Prosecutors moved to dismiss a vandalism case against David Hearn, saying the damage was the result of a “botched installation,” prosecutors said.

The government had accused Hearn of ripping a piece of sealant following a $14 million renovation, prosecutors said.

Hearn has repeatedly said he only touched the water in the pool out of curiosity last month, Hearn said.

Prosecutors asked a court to drop the case on the basis that the installation, not intentional conduct, caused the sealant to fail, prosecutors said.
